Terms of Service

These Terms of Service ("Terms") govern your use of the TaxMiles mobile application and the taxmilesapp.com website (collectively, the "Service"), operated by TaxMiles ("we", "our", or "us"). By using the Service, you agree to these Terms.

1. Acceptance of Terms

By downloading, installing, or using TaxMiles, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

2. Description of Service

TaxMiles is a mileage tracking application that helps users record driving trips, classify them as business or personal, track vehicle expenses and fuel economy, attach photos and voice notes to trips, manage trip templates, receive driving reminders, integrate with calendar events, view mileage forecasts and audit readiness scores, generate IRS-compliant reports, and access trip data via CarPlay. The Service is available as a free version with limited features and as paid subscription plans with additional capabilities.

3. Eligibility

You must be at least 18 years old to use TaxMiles. By using the Service, you represent that you are at least 18 years of age and have the legal capacity to enter into these Terms.

4. Account and Data

Sign in with Apple (Optional)

• TaxMiles supports Sign in with Apple for optional account identification. No account is required to use the app.
• When you sign in with Apple, Apple provides us with a unique user identifier and, optionally, your name and email address. We never receive your Apple ID password.
• You can sign out at any time in Settings > Account. Your data remains on your device.
• You can delete your account and all data in Settings > Account > Delete Account & Data.

iCloud Sync

• If you are signed into iCloud on your device, your trip data syncs automatically to your personal iCloud account.
• Data is encrypted end-to-end by Apple. We cannot read or access your iCloud data.
• If you sign into the same iCloud account on another device, your data will sync there as well.

Your Responsibilities

• You are responsible for the accuracy of the data you enter into the app, including trip details, mileage, and expense amounts.
• You are responsible for maintaining the security of your device and any data stored on it.
• We recommend regularly exporting your data as a backup.

5. Subscriptions and Payments

Free Plan

The free plan includes up to 40 tracked trips per month with basic features including IRS rate updates, basic audit score, annual mileage forecast, up to 3 trip templates, 1 photo per trip, and current MPG tracking. No payment is required.

Paid Plans

• Paid subscriptions are billed through Apple's App Store and are subject to Apple's terms and conditions.
• Subscriptions automatically renew at the end of each billing period (monthly or annually) unless cancelled at least 24 hours before the end of the current period.
• You can manage and cancel subscriptions in your Apple ID account settings.
• Free trial periods, if offered, automatically convert to a paid subscription unless cancelled before the trial ends. We will send a reminder notification before your trial ends.
• Refunds are handled by Apple according to their refund policy.

Pro Plan

Includes everything in Free, plus: unlimited trips, unlimited templates, calendar integration, trip splitting, multi-stop trip view, AI auto-categorization, receipt OCR scanning, voice notes with transcription, CPA Export Mode with Schedule C reports, per-trip audit drill-down, up to 10 photos per trip, CarPlay support, cloud sync, and priority support.

Pricing

• Pro: $5.99/month or $39.99/year

Prices may change with advance notice. Existing subscribers will be notified before any price increase takes effect.

6. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose, including fabricating or inflating mileage for fraudulent tax deductions.
• Reverse engineer, decompile, or disassemble any part of the app.
• Attempt to gain unauthorized access to our systems or other users' data.
• Use the Service in any way that could damage, disable, or impair its functionality.
• Redistribute, sublicense, or resell the Service.

7. Intellectual Property

The TaxMiles app, website, brand, logo, and all related content are owned by TaxMiles and protected by copyright and intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the app for personal or business mileage tracking purposes.

8. Device Permissions

Certain features require device permissions. You can grant or revoke any permission at any time in iOS Settings:

• Location (required for tracking): GPS access for recording driving routes and calculating mileage.
• Motion & Fitness: Accelerometer and CoreMotion for auto-detecting driving and powering missed-trip reminders.
• Calendar (optional): Read-only access to match calendar events to trips as business purposes.
• Microphone (optional): For recording voice notes attached to trips. Audio is processed on-device only.
• Speech Recognition (optional): On-device transcription of voice notes. No audio is sent to external servers.
• Camera (optional): For scanning receipts and attaching photos to trips.
• Notifications (optional): For missed-trip reminders, trial expiration alerts, and IRS rate update notifications.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. We do not warrant that:

• The Service will be uninterrupted, error-free, or completely secure.
• GPS tracking will be 100% accurate at all times.
• Mileage calculations will be precise to the exact mile in all conditions.
• Tax deduction estimates will match your actual tax liability.
• Speech recognition transcriptions will be 100% accurate.
• Calendar event matching will always identify the correct business purpose.
• Audit readiness scores guarantee compliance with IRS requirements.
• Mileage forecasts will accurately predict your future driving.

10. Tax Disclaimer

TaxMiles is not a tax advisor. The app provides tools to track mileage and estimate potential deductions based on the IRS standard mileage rate. However:

• We do not provide tax, legal, or financial advice.
• Deduction estimates are approximations and may not reflect your actual tax situation.
• You are solely responsible for the accuracy of your tax filings.
• We recommend consulting a qualified tax professional for tax-related decisions.
• IRS mileage rates are subject to change; the app will update rates periodically but may not reflect changes immediately.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TAXMILES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR TAX PENALTIES, ARISING FROM YOUR USE OF THE SERVICE.

Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $50, whichever is greater.

12. Indemnification

You agree to indemnify and hold harmless TaxMiles from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

13. Termination

• You may stop using the Service at any time by deleting the app.
• You may delete your account and all data at any time in Settings > Account > Delete Account & Data.
• We may suspend or terminate your access to the Service if you violate these Terms.
• Upon termination, your right to use the Service ceases immediately. Data stored on your device remains under your control.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date and, where appropriate, through an in-app notification. Continued use of the Service after changes constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of the United States. Any disputes arising from these Terms shall be resolved in the courts of the jurisdiction where TaxMiles is headquartered.
